1. Agreement
These terms are an agreement between you and OquMail. They apply when you use our website (oqumail.com), the webmail and admin app (app.oqumail.com), the transactional email API (api.oqumail.com) or our mail servers, including IMAP and SMTP access.
By creating an account or using the service, you agree to these terms. If you sign up on behalf of a business, you confirm that you are allowed to accept these terms for it, and "you" includes that business. If you do not agree, do not use the service.
2. The service
OquMail provides business email hosting on your own domain. The service includes:
- Webmail for reading, writing and organizing email in your browser, plus an admin area for managing your workspace.
- IMAP and SMTP access so you can use your mailboxes in other email apps.
- A transactional email API for sending email from your own applications using API keys.
- Domain management for connecting your domains, verifying them and setting up the DNS records needed to send and receive mail.
3. Eligibility and accounts
- OquMail is a service for businesses and other organizations. You must be at least 16 years old to use it.
- Give us accurate information when you sign up and keep it up to date.
- Keep your passwords, sign-in codes and API keys safe and do not share them. You are responsible for activity that happens under your account, mailboxes and API keys. Tell us right away at hello@oqumail.com if you think any of them have been compromised.
- The owner of a workspace is responsible for the people they add to it, including making sure every member follows these terms. Workspace owners and admins can manage members' mailboxes, including resetting passwords and removing them.
4. Free plan and limits
OquMail is free to use within these limits for each workspace:
- Up to 15 mailboxes.
- Up to 3 domains.
- 5 GB of storage per mailbox.
- Up to 250 outgoing emails per mailbox per day, and a workspace total of 250 per day for each mailbox allowed on the plan.
- Short bursts of sending are also limited, to 10 emails per minute per mailbox.
If you need more than 15 mailboxes, contact us at hello@oqumail.com. Extra mailboxes cost $1 per mailbox per month and are arranged with us directly.
When a mailbox is full, new incoming mail may be rejected until space is freed. When a sending limit is reached, further messages are not sent until the limit resets.
We may change these limits or the price of extra mailboxes. We will give you notice before a change that reduces your limits or increases what you pay, by email or in the app.
5. Your domain and DNS
- You may only add domains that you own or are authorized to control.
- You are responsible for your domain registration and for keeping your DNS records, including MX, SPF, DKIM and DMARC, set up correctly. If these records are missing, changed or wrong, email may not be delivered to you or from you.
- If you let your domain registration lapse, or move your MX records elsewhere, mail for that domain will stop reaching OquMail.
- If you connect a DNS provider account for one-click setup, you authorize us to create and update the DNS records needed for OquMail on your behalf.
6. Acceptable use
You must not use OquMail, or let anyone else use it, to:
- Send spam or unsolicited bulk email, including to purchased, rented or scraped address lists.
- Send phishing messages, or collect passwords, payment details or other credentials.
- Distribute malware, viruses or other harmful code.
- Impersonate any person, business or organization, or mislead recipients about who a message is from.
- Send, store or share illegal content, or content that infringes other people's rights.
- Host "reply drop-boxes": mailboxes set up to receive replies to scams, fraud or phishing, whether or not the scam emails were sent through OquMail.
- Harass, threaten or abuse anyone.
- Get around our limits, for example by creating extra workspaces or accounts to send more mail, or by interfering with our security measures.
- Attack, overload, probe or disrupt our systems, or anyone else's.
If you use the transactional API, stay within the rate limits set for each API key, and send only email your recipients expect, such as receipts, sign-in codes and account notices.
7. Enforcement
To protect recipients, other customers and our sending reputation, we check outgoing mail for signs of abuse, as described in our Privacy Policy. If we believe these terms have been broken, or we receive a credible abuse report from a third party, we may:
- Hold or refuse to send individual messages.
- Pause sending for a mailbox or workspace.
- Revoke API keys.
- Suspend or close the mailboxes, domains or workspaces involved.
Some of these steps happen automatically, for example when a mailbox's bounce or complaint rate gets too high. Where appropriate, we will tell you what happened and why. We may act without notice when there is serious or ongoing abuse, or when notice would put others at risk. If you think we got it wrong, contact us at hello@oqumail.com and a person will review it.
8. Your content
You own the email, attachments and other content you store or send with OquMail. You are responsible for that content and for having the right to send it.
You give us a limited permission to host, store, copy, process, transmit and display your content only as needed to run, secure and improve the service, including checking mail for spam and abuse. This permission ends when your content is deleted from our systems, except where we are allowed to keep records as described in our Privacy Policy.
9. Data export and deletion
- You can export your email at any time by connecting any IMAP email app to your mailbox and downloading it.
- When an account is closed, sign-in and mail access stop right away. We keep the data for up to 30 days so a closure made by mistake, or by someone else, can be reversed. After that, the mail, attachments, support tickets and personal details are permanently erased and cannot be recovered.
- Export anything you want to keep before you close your account. Some security and delivery records may be kept longer, as described in our Privacy Policy.
10. Privacy
Our Privacy Policy explains what personal data we collect, how we use it and the choices you have. For mail stored in your workspace, you are responsible for having a lawful basis to handle the personal data it contains, and we process it on your behalf to run the service.
11. Availability and changes to the service
- We work to keep OquMail running reliably, but we do not guarantee any particular uptime, and the service may sometimes be unavailable or slow.
- We may carry out maintenance, which can briefly interrupt the service. We try to keep this short and to give notice of planned work where we can.
- We may add, change or remove features. If we remove a major feature you rely on, we will try to give you reasonable notice.
- Email delivery depends on other mail servers that we do not control. We cannot guarantee that a message will be delivered, accepted or placed in the recipient's inbox.
12. Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, including any implied promises that the service is fit for a particular purpose, uninterrupted, error-free or that it will never lose data. Keep your own copies of any email that is important to you. Nothing in these terms limits rights you have under law that cannot be waived.
13. Limitation of liability
To the extent the law allows:
- We are not liable for indirect or consequential losses, such as lost profits, lost business, lost revenue or lost data, arising from your use of the service or your inability to use it.
- Our total liability to you for any claims relating to the service is limited to the amount you paid us for the service in the 12 months before the claim arose.
These limits do not apply to liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.
14. Indemnity
If someone makes a claim against OquMail because of your content, your domains, how you or your workspace members used the service, or a breach of these terms, you agree to cover the reasonable losses and costs, including legal fees, that we incur as a result.
15. Termination
By you. You can stop using OquMail at any time. To close your account, email us at hello@oqumail.com from your account's sign-in address.
By us. We may suspend or close your account if you break these terms, if we are required to by law, if your account creates a risk for other customers or for our service, or if we stop offering the service. Except in cases of abuse or legal requirement, we will give you notice so you can export your email first.
After closure, your data is handled as described in Data export and deletion. Sections of these terms that by their nature should continue, such as disclaimers, limitation of liability and indemnity, continue to apply.
16. Changes to these terms
We may update these terms as the service changes. We will change the "Last updated" date above, and for material changes we will notify account holders by email or in the app before they take effect. If you keep using OquMail after changes take effect, you accept the updated terms. If you do not agree, you can close your account.
